Sliding Scale Federal Share Rates
Higher federal share rates are available to some states based on the ratio of designated public lands area to the total area of each state, as described in 23 U.S.C. 120(b)(1).
Additional higher federal share rates are based on the ratio of the area of nontaxable Indian land, public domain lands (reserved and unreserved), national forest, and national parks and monuments to the total area of each state, and are available only for states that have already in place signed agreements with the Federal Highway Administration (FHWA) under 23 U.S.C. 120(b)(2). The agreement should be saved in the Recipient Documents in TrAMS.
These rates may apply to FTA 5311 and transferred FHWA Congestion Mitigation and Air Quality Improvement (CMAQ) or Surface Transportation Block Grant (STBG) program funds (administered in FTA 5307, 5310, or 5311 grants), and FTA 5303 and 5304 funds in a Consolidated Planning Grant (CPG) where the rate is also applied to the FHWA PL funds.
Note: CMAQ funds transferred to FTA retain the traditional 80% federal share ̶ subject to the sliding scale for 80/20 projects ̶ even if funding transit operations (vs. FTA 5310 or 5311 for operations subject to sliding scale for a 50/50 share ratio).
