Dear Ms. Hakim:

This letter is in reference to the Federal Transit Administration's (FTA) review of lift reliability, maintenance, and operation on fixed route service operated by the New Jersey Transit Corporation (NJ Transit). The review was originally conducted from September 14-18, 2009. Enclosed is a copy of the Final Report, which will be posted on PTA's website on our ADA page. As of the date of this letter, the Final Report is considered a public document and is subject to dissemination under the Freedom of lnformation Act of 1974.

The FTA Office of Civil Rights is responsible for ensuring that providers of public transportation comply with the Americans with Disabilities Act of 1990 (ADA), Section 504 of the Rehabilitation Act of 1973, and the U.S. Department of Transportation's (DOT) implementing regulations at 49 CFR Parts 27, 37, 38, and 39. As part of our ongoing oversight efforts, FTA conducts a number of onsite compliance reviews to ensure compliance with the ADA and the applicable departmental regulations. FTA utilizes the findings from these reviews to provide technical assistance to transit agencies in order to achieve compliance with the ADA.

FTA recognizes that more than four years have passed since our onsite review and changes are likely to have occurred. This report reflects the observations of our review team at the time of the onsite review. It is not intended to address NJ Transit's current state of overall compliance with the DOT ADA regulations, which may be affected by factors beyond the scope of this review. We recognize that given the passage of several years, there may be findings included within this report that have already been addressed. We still ask that you review the findings detailed in this report and provide us with the requested information.

At this time, we ask that NJ Transit provide FTA with a written response within 30 days of the date of this letter listing its proposed corrective actions and implementation dates. If a finding has already been addressed, please indicate when the change was made and what actions were taken. FT A will use this response to monitor NJ Transit's progress since the time of the review and to resolve any outstanding deficiencies. NJ Transit will have 30 days from the time it submits the proposed corrective actions and implementation dates to address any unresolved findings.
